Terms of Use

Please read these Terms and Conditions carefully before accessing or using the OATH Service.

1. Interpretation and Definitions

1.1 Interpretation

Capitalized terms have the meanings provided in this Section or otherwise defined in these Terms.

1.2 Definitions

  • Application means the mobile application titled "OATH," including all related features, tools, content, and updates.
  • Company, We, Us, or Our means OATH, operated by Meriton Ameti.
  • Device means any device capable of accessing the Service.
  • Service means, collectively, the Application, the Website, associated software, content, and any services offered by the Company.
  • Witness means the accountability partner designated by a User to receive automated notifications when the User misses a scheduled workout.
  • You means the individual using the Service.

2. Agreement to Terms

Your access to and use of the Service is conditioned upon Your acceptance of these Terms and the OATH Privacy Policy. By accessing or using the Service, You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must discontinue use of the Service.

3. Eligibility

You represent and warrant that You are at least 13 years old. If You are between 13 and 17 years old, You may only use the Service with the consent and supervision of a parent or legal guardian.

4. Description of the Service

OATH is an automated accountability application. The Service allows You to:

  • Set a binding workout schedule for each week
  • Designate a Witness (accountability partner) from Your contacts
  • Check in at Your designated gym using GPS verification
  • Automatically notify Your Witness via SMS if You miss a scheduled workout

Once a weekly schedule is set, it cannot be modified until the following week. This is by design and is a core part of the commitment contract.

5. GPS and Location Services

The Service requires access to Your device's location services to verify gym attendance. By using the Service, You consent to this location data being collected during the check-in process. Location data is not continuously tracked and is only used to confirm You are physically present at Your designated gym.

6. Witness Notifications and SMS

By designating a Witness, You authorize OATH to send automated SMS messages to Your Witness when You fail to check in at the gym on a scheduled day. You represent that You have informed Your Witness and that they have consented to receiving these messages.

OATH is not responsible for any personal, social, or professional consequences resulting from these notifications. The purpose of the Service is to create accountability through social pressure, and You accept this mechanism by using the Service.

7. Health and Fitness Disclaimers

OATH does not provide medical advice, fitness training, or professional health services. The Service is an accountability tool and does not prescribe, recommend, or monitor specific exercises or physical activities.

  • You are solely responsible for ensuring that Your workout routine is appropriate for Your physical condition.
  • Consult a licensed medical professional before beginning any exercise program.
  • The Company is not liable for any injury or health issue arising from Your use of the Service or any workout You perform.

8. Prohibited Uses

You agree not to:

  • Spoof or falsify Your GPS location to fraudulently check in
  • Use the Service to harass, intimidate, or bully any person, including Your Witness
  • Designate a Witness without their knowledge or consent
  • Reverse engineer, decompile, or attempt to extract the source code of the Application
  • Use the Service for any unlawful purpose
  • Interfere with the operation of the Service

9. Subscription, Billing, and In-App Purchases

Purchases and subscriptions are processed through third-party platforms such as the Apple App Store and Google Play Store. Their terms govern payment processing, renewals, and refunds. Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.

10. Intellectual Property

All rights in the Service are owned exclusively by the Company or its licensors. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service.

11. Termination

The Company may suspend or terminate Your access at any time if You violate these Terms. Upon termination, all rights granted to You immediately cease. You may also terminate Your Account at any time by contacting Us.

12. "As Is" and "As Available" Disclaimer

The Service is provided without warranties of any kind, express or implied. The Company disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that GPS verification will always function accurately or that SMS messages will always be delivered.

13. Limitation of Liability

To the maximum extent allowed by law, the Company's total liability shall not exceed the greater of:

  • The amount You paid in the preceding 12 months, or
  • One hundred dollars (USD $100).

The Company is not liable for indirect, incidental, or consequential damages, including loss of profits, data, personal embarrassment, or social consequences arising from the use of the Service.

14. Governing Law

These Terms are governed by applicable law. You agree to the jurisdiction of the relevant courts for any disputes arising from the use of the Service.

15. Severability and Waiver

If any provision is found invalid, the remaining provisions remain in effect. Failure to enforce a right does not constitute a waiver.

16. Changes to These Terms

The Company may update these Terms at any time. Material changes will be announced through reasonable notice. Continued use after updates constitutes acceptance.
